Qin claimed that at 8 pm on March 1, 2013, when he was passing by the east gate of UME Cinema in Dongcheng District, he was knocked to the ground by a large dog that was running rapidly, causing his whole body and head to fall to the ground. When the dog owner Pang was about to take the dog away, he was stopped by Qin's family and called the police. Qin broke the jade bracelet on his left hand and damaged his leather jacket. A week later, his tinnitus and dizziness worsened. On March 18, he called an ambulance and was admitted to Beijing Anzhen Hospital. He was diagnosed with concussion, neurological tinnitus in his left ear, left hip trauma, and anxiety. He was discharged after a week of treatment. Because the two parties could not reach an agreement on compensation, they went to court. The jade bracelet has an estimated market value of RMB 30,000.

The dog owner Pang argued that Qin was afraid of falling, not because he was knocked down by the dog. Regarding the loss of the jade bracelet, Pang only agreed to bear the reasonable part of the loss.
The court held that in this case, the plaintiff did not commit intentional or gross negligence. The defendant Pang failed to fulfill his obligation to properly manage the animals he raised and should compensate the plaintiff Qin for his reasonable losses. The court recognized the plaintiff’s medical expenses at Beijing Jishuitan Hospital. In the end, the court ruled that the dog owner Pang should compensate Qin for various losses totaling 34,581.5 yuan. Beijing Morning News (Reporter Yue Yilei)
